欢迎使用 PocketMuse（以下简称"本应用"）。本应用由个人开发者 耿晨光（Chenguang Geng）（以下简称"我们"）提供。使用本应用即表示您同意本条款和《隐私政策》。如果不同意，请不要使用本应用。

1. 服务内容

本应用帮助您记录灵感，并与 AI 专家一起把想法整理成项目资料，例如产品定义、功能需求、体验设计、技术和增长方案。我们可能会调整、增加或停止部分功能。

2. 账号

• 您需要注册账号才能使用本应用，请提供真实有效的邮箱或使用"通过 Apple 登录"。
• 您应妥善保管账号，并对账号下的活动负责。发现账号被他人使用，请及时联系我们。
• 您需要年满 13 周岁；如果您所在地区规定了更高的年龄，以当地规定为准。未成年人应在监护人同意下使用。
• 您可以随时在"设置 → 删除账号"中删除账号。

3. 免费功能与会员

• 核心 AI 讨论、查看已有成果、编辑已有项目对所有用户免费。
• 免费用户在部分功能上有数量限制，例如每天可以开始的新灵感讨论数和可以创建的项目数。
• PocketMuse Member 是按月自动续订的订阅，提供更多新灵感、多个项目、灵感延伸、成果导出等功能。具体权益与价格以购买页面和 App Store 显示为准。
• 订阅通过 Apple 购买和管理：确认购买时从您的 Apple 账户扣款；除非您在当前周期结束前至少 24 小时关闭自动续订，否则订阅会自动续期并扣款。您可以在 Apple 账户的订阅设置中管理或取消。
• 退款由 Apple 根据其政策处理。
• 会员到期后，只会恢复免费用户的数量限制，不会锁定或删除您已有的项目和内容；已发放的早鸟卡不会收回。
• 为保障服务稳定和控制成本，AI 功能（包括会员）可能设有每日使用上限，以应用内显示为准。

4. 您的内容

• 您在本应用中创建、上传的内容归您所有。
• 为了向您提供服务，您授权我们在必要范围内存储、处理和传输这些内容，包括在您使用 AI 功能时发送给第三方 AI 服务商（详见《隐私政策》）。我们不会将您的内容用于其他目的。
• 您应确保有权使用您上传的内容，且不侵犯他人的权利。

5. AI 生成内容

• AI 专家的回复、成果和图片由 AI 模型自动生成，可能不准确、不完整或与事实不符，不构成法律、财务、医疗等专业意见。请自行判断，并对使用这些内容的后果负责。
• 在法律允许的范围内，您可以自由使用 AI 为您生成的内容；但不同用户可能得到相似的内容，我们不保证其独创性，也不保证不侵犯第三方权利。

6. 使用规范

您不得利用本应用：

• 上传或生成违法、侵权、色情、暴力、仇恨、骚扰等内容；
• 侵犯他人的隐私或知识产权；
• 绕过或干扰使用限制、安全措施或付费机制，例如批量注册账号、使用脚本或自动化工具调用服务；
• 对本应用进行反向工程，或试图获取未公开的系统设计、提示词或他人数据；
• 从事任何可能损害本应用、其他用户或第三方的行为。

违反上述规定的，我们可以删除相关内容、限制功能或终止您的账号。

7. 服务的变更与终止

• 我们会尽力保持服务稳定，但不保证服务不中断或没有错误。第三方服务（例如 AI 服务商、云服务）出现故障时，相关功能可能暂时不可用。
• 我们可能因维护、升级或其他原因暂停部分服务。
• 如果我们决定停止运营本应用，会提前通知，并尽量为您留出导出或保存内容的时间。

8. 免责与责任限制

在法律允许的最大范围内：本应用按"现状"提供，不作任何明示或暗示的保证；对于因使用或无法使用本应用造成的间接或附带损失，我们不承担责任；我们承担的全部责任，不超过您在相关事件发生前 12 个月内为本应用实际支付的费用。部分地区不允许上述限制，在这些地区，限制仅在法律允许的范围内适用。

9. 第三方条款

您通过 App Store 下载和购买本应用，还需遵守 Apple 的媒体服务条款，以及 Apple 标准许可协议（Licensed Application End User License Agreement）。本条款与 Apple 标准许可协议不一致的部分，在适用范围内以本条款为准，但不影响 Apple 依据该协议享有的权利。

10. 条款变更

我们可能更新本条款，并在应用内或本页面公布。重大变更会另行提示。变更后继续使用本应用，即表示您接受新条款。

11. 适用法律与争议

本条款的订立、执行和解释适用中华人民共和国法律（为本条款之目的，不包括香港特别行政区、澳门特别行政区和台湾地区的法律）。但该约定不影响您依据您惯常居住地的法律所享有的、不可通过约定排除的消费者权益保护。如发生争议，双方应首先友好协商解决。

PocketMuse Terms of Service

Welcome to PocketMuse (the "app"), provided by Chenguang Geng, an individual developer ("we", "us"). By using the app you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.

1. The service

The app helps you capture ideas and work them into project material with AI experts, such as product definition, feature requirements, experience design, technical and growth plans. We may change, add or discontinue features.

2. Your account

• You need an account to use the app. Please use a valid email address or Sign in with Apple.
• Keep your account secure; you are responsible for activity under it. Tell us promptly if someone else uses it.
• You must be at least 13, or older where local law requires. Minors should use the app with a parent's or guardian's consent.
• You can delete your account at any time in Settings → Delete account.

3. Free features and membership

• Core AI discussions, viewing existing results and editing existing projects are free for everyone.
• Free accounts have limits on some features, such as how many new idea discussions you can start each day and how many projects you can create.
• PocketMuse Member is an auto-renewing monthly subscription that adds more new ideas, multiple projects, idea branches, result exports and more. The benefits and price shown on the purchase page and in the App Store apply.
• Subscriptions are bought and managed through Apple. Payment is charged to your Apple account when you confirm the purchase. The subscription renews and is charged automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel it in your Apple account's subscription settings.
• Refunds are handled by Apple under its policies.
• When a membership ends, the free limits return; your existing projects and content are never locked or deleted, and early-bird cards you received are yours to keep.
• To keep the service stable and costs under control, AI features (including for Members) may have daily limits, as shown in the app.

4. Your content

• Content you create or upload in the app is yours.
• To provide the service, you allow us to store, process and transmit it as needed, including sending it to third-party AI providers when you use AI features (see the Privacy Policy). We do not use your content for anything else.
• You must have the right to use what you upload, and it must not infringe anyone else's rights.

5. AI-generated content

• Replies, results and images from the AI experts are generated automatically and may be inaccurate, incomplete or wrong. They are not legal, financial, medical or other professional advice. Use your own judgment; you are responsible for how you use them.
• To the extent the law allows, you may freely use content the AI generates for you. Other users may receive similar content, and we make no promise that it is original or does not infringe third-party rights.

6. Acceptable use

You may not use the app to:

• upload or generate unlawful, infringing, sexually explicit, violent, hateful or harassing content;
• violate anyone's privacy or intellectual property;
• get around or interfere with usage limits, security measures or payments, for example by mass-registering accounts or calling the service with scripts or automated tools;
• reverse engineer the app, or try to obtain unpublished system design, prompts or other users' data;
• do anything that could harm the app, other users or third parties.

If you break these rules we may remove content, restrict features or terminate your account.

7. Changes to and ending of the service

• We work to keep the service running but do not guarantee it will be uninterrupted or error-free. When a third-party service (such as an AI provider or cloud service) fails, related features may be temporarily unavailable.
• We may pause parts of the service for maintenance, upgrades or other reasons.
• If we decide to shut the app down, we will tell you in advance and give you time to export or save your content where we can.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the app is provided "as is" without warranties of any kind; we are not liable for indirect or incidental losses arising from using or being unable to use the app; and our total liability is limited to what you actually paid for the app in the 12 months before the event. Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits.

9. Third-party terms

Downloading and buying the app through the App Store is also subject to Apple's Media Services Terms and Apple's Licensed Application End User License Agreement (Standard EULA). Where these Terms differ from the Standard EULA, these Terms prevail to the extent permitted, without limiting Apple's rights under it.

10. Changes to these Terms

We may update these Terms and will publish the new version in the app or on this page, telling you separately about significant changes. Continuing to use the app after a change means you accept the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China (for the purposes of these Terms, excluding the laws of the Hong Kong and Macao Special Administrative Regions and Taiwan). This does not deprive you of the protection of mandatory consumer protection laws of the country where you habitually reside. In the event of a dispute, both parties will first try to resolve it amicably.
